नेदरल्याण्ड्समा बाल सम्पर्क: कहिले प्रतिबन्धित गर्न सकिन्छ?

Child contact (omgang) in the Netherlands can be restricted by the court whenever the child’s interests require it, but it can only be refused entirely on one of four grounds in Article 1:377a(3) of the Dutch Civil Code (BW): serious harm to the child’s development, a parent who is manifestly unfit or unable, serious objections from a child aged twelve or older, or compelling interests of the child. A difficult relationship between the parents is not enough.

This article explains where the right to contact comes from, how the four grounds work, what the court does before it limits contact, which middle-ground options exist, and how an arrangement is enforced or changed.

Where does the right to contact come from?

Under Article 1:377a(1) BW, the child has a right to contact with both parents and with anyone who has a close personal relationship with the child. A parent without parental authority has both the right and the duty to have contact with the child.

Contact is therefore the child’s entitlement, not something the resident parent grants. A grandparent, step-parent or former partner of a parent can also ask the court for contact if they can show a close personal relationship. Article 8 of the European Convention on Human Rights, which protects family life, applies directly in Dutch proceedings and supports the same starting point.

How do contact, care and parental authority differ?

Dutch law separates three concepts that other systems combine under “custody”. Parental authority (gezag) is the power to take major decisions about the child. Contact (omgang) is the arrangement for a parent without authority; a care arrangement (zorgregeling) is the equivalent when both parents hold authority.

Under Article 1:251b BW, the mother and a person who acknowledges the child (erkenning) exercise authority jointly by law, subject to exceptions; this rule applies to acknowledgements from 1 January 2023. After divorce, joint authority continues unless the court decides otherwise. A parent with sole authority must inform and consult the other parent on important matters about the child under Article 1:377b BW. See our डच पारिवारिक कानून गाइड.

When can the court refuse contact altogether?

Only on one of the four grounds in Article 1:377a(3) BW; the list is exhaustive. The court can deny contact for a fixed or indefinite period, but a full denial is the most far-reaching measure and must be specifically reasoned.

  • Serious harm to the child’s mental or physical development (ground a). Typical cases are violence at home, abuse, serious neglect, or untreated addiction or psychiatric illness. Witnessing violence between the parents also counts. Courts look for documents: police reports, reports of the family doctor or youth care, or a criminal conviction.
  • A parent who is manifestly unfit or manifestly unable to have contact (ground b). The question is not whether the parent is a good parent, but whether contact can function at all.
  • Serious objections from a child aged twelve or older (ground c). The objections must be expressed when the child is heard. The court considers whether they are the child’s own or the result of pressure.
  • Contact is otherwise contrary to compelling interests of the child (ground d). This covers, for example, a real risk of abduction or a conflict so severe that every contact keeps the child caught in the middle.

A refusal applies as long as the ground exists. Under Article 1:377e BW, the court can change a contact decision if circumstances have changed or the decision was based on incorrect or incomplete information. A parent who has completed treatment can therefore ask for a review.

What does the court do before restricting contact?

The parent who wants contact restricted files a petition (verzoekschrift) with the district court through a lawyer, and must put forward concrete, documented facts. General allegations rarely succeed.

Three instruments often shape the outcome. First, the court can ask the Child Care and Protection Board (Raad voor de Kinderbescherming) to investigate; its report carries great weight but takes months. Second, under Article 809 of the Dutch Code of Civil Procedure (Rv), the court gives children aged twelve or older the opportunity to give their views, usually in a short conversation without the parents; younger children may also be heard. Third, the court can appoint a special guardian (bijzondere curator) to represent the child’s own interests in an entrenched conflict.

The court can make a provisional order during the proceedings. In urgent situations, a contact ban can be sought in summary proceedings (kort geding), and the mayor can impose a temporary domestic exclusion order (tijdelijk huisverbod).

What are the alternatives to refusing contact?

In most difficult cases the outcome is not a refusal but a restricted form of contact. Under Article 1:377a(2) BW, the court sets an arrangement that serves the child, possibly for a fixed period, and chooses the least intrusive measure that still protects the child.

  • Supervised contact: contact in the presence of a professional, often at a contact centre (omgangshuis), usually for a limited number of sessions followed by an evaluation.
  • Supervised handovers: only the handover is supervised, for parents who cannot manage a handover themselves.
  • Phased build-up: short, frequent contact at a neutral place, extended as it works, for example after a long break or with a very young child.
  • नियमहरू: for example treatment, no alcohol before or during contact, no travel abroad, or communication in writing only.

If the conflict between the parents itself harms the child, the juvenile court can impose a supervision order (ondertoezichtstelling) at the request of the Child Care and Protection Board. A certified youth care institution then guides the family and can give instructions about contact.

How do you agree on an arrangement without litigation?

Parents who divorce and share authority over minor children must file a प्यारेन्टिंग योजना (ouderschapsplan) signed by both with the divorce petition, under Article 815(2) Rv. The plan records the division of care, how the parents inform and consult each other, and how the costs of the children are shared.

A good plan covers the weekly rhythm, holidays, handovers, school and medical decisions, communication, relocation and a review moment. मध्यस्थता is not compulsory in the Netherlands, but courts do refer parents to it, and arrangements parents make themselves are followed more often. Mediation is not suitable where there has been violence or coercive control; then protective measures come first.

How is a contact arrangement enforced?

A contact arrangement in a court order is enforceable. The court first examines why the arrangement stopped working, because enforcement involving a child is a blunt instrument.

The available measures, in increasing severity, are a penalty payment (dwangsom) per missed contact, an order to hand over the child with police assistance, and, very exceptionally, civil detention (lijfsdwang). Persistent, deliberate obstruction can lead the court to change the arrangement or the child’s main residence. Under Article 279 of the Dutch Criminal Code (Sr), intentionally removing a minor from the person lawfully exercising authority is a criminal offence; a criminal complaint runs alongside the civil route but does not return the child by itself. Document every missed contact with dates and messages.

What about relocation and international cases?

A parent with joint authority may not move with the child, and certainly not abroad, without the other parent’s consent. Without consent, the court decides on the dispute, weighing the need for the move, its preparation, alternatives, the compensation offered for lost contact and the effect on the child.

Within the EU, jurisdiction over parental responsibility follows the child’s habitual residence under the Brussels IIb Regulation; outside the EU, the 1996 Hague Child Protection Convention plays a similar role. Wrongful removal or retention abroad falls under the 1980 Hague Child Abduction Convention, which aims at a quick return; in the Netherlands, these cases are concentrated at the District Court of The Hague. How do you appeal a contact decision?

Under Article 358(2) Rv, an appeal must be lodged with the court of appeal within three months of the date of the decision. The decision usually continues to apply during the appeal, and the court of appeal assesses the situation as it stands at the time of its own decision.

What should you check as a parent who wants contact restricted?

  • Check which of the four grounds of Article 1:377a(3) BW applies if you want contact refused completely.
  • Collect documents: police reports, medical or youth care reports, messages and a dated log.
  • Propose a lighter alternative, such as supervised or phased contact, unless the child is unsafe.
  • Do not stop contact on your own without a court order or urgent safety reason; obstruction can be held against you.
  • Consider urgent measures such as a contact ban in summary proceedings if there is immediate danger.

What should you check as a parent whose contact is restricted?

  • Check whether the court actually refused contact or only restricted it, and for how long.
  • Keep a record of every missed contact and of your attempts to resolve it.
  • Comply with conditions such as treatment, and document the results for a later review under Article 1:377e BW.
  • Check the three-month appeal deadline under Article 358(2) Rv.
  • If you have no authority, ask the other parent for information about the child under Article 1:377b BW.

बारम्बार सोधिने प्रश्नहरू

Can I stop contact if I think my child is not safe?

In an acute emergency you protect the child first and contact the police or Veilig Thuis. Otherwise, ask the court to restrict or suspend contact. Stopping contact on your own without good reason is a breach of the court order and can be held against you.

Does my child of twelve decide about contact?

No. A child of twelve or older is heard under Article 809 Rv, and serious objections are a ground for refusing contact under Article 1:377a(3)(c) BW. But the court decides, and considers whether the objections are the child’s own.

Do conflicts between parents justify refusing contact?

Not on their own. Only if the conflict is so severe that contact is contrary to compelling interests of the child can the court refuse contact. Usually the court chooses supervised handovers or other conditions instead.

How long does a contact procedure take?

Often several months, especially if the court asks the Child Care and Protection Board to investigate. In urgent situations, a provisional order or summary proceedings are faster.
