In Dutch court proceedings the losing party is ordered to pay the costs of the proceedings under Article 237 of the Code of Civil Procedure (Rv), but that order does not cover the winner’s actual lawyer’s bill. It covers the court fee, bailiff costs and a fixed contribution to legal fees under a scale called the liquidatietarief, which is usually well below the real bill; the main exceptions are intellectual property cases and cases between family members.

Winning a case in the Netherlands therefore still costs money, and losing costs less than in a full cost-shifting system but more than most people budget for. This article explains what the costs are, what a cost order covers, and how to budget a dispute.

What are the costs of a Dutch court case?

The bill has four parts: the court fee, the cost of starting the case, your own lawyer and the costs the case itself generates. Only some of them are recoverable from the other side.

The court fee (griffierecht) is fixed by the Court Fees in Civil Cases Act (Wet griffierechten burgerlijke zaken). It depends on the value of the claim and the type of litigant, with lower rates for natural persons and for people with limited means. The amounts change every year, so check the current table on rechtspraak.nl rather than older figures found online.

Proceedings started by writ of summons (dagvaarding) must be served by a bailiff (deurwaarder) at a regulated tariff. Proceedings started by petition (verzoekschrift), the route for most employment dismissal and family matters, need no bailiff for the start.

Your own lawyer’s fee is agreed between you and the firm, by hourly rate, a fixed fee per phase or a combination, and is normally by far the largest item. Court-appointed experts, witness expenses, translations and legalisation of foreign documents come on top.

What does a cost order actually cover?

Under Article 237 Rv the court orders the losing party to pay the costs of the proceedings. For the lawyer’s part, courts apply the liquidatietarief, a scale drawn up by the judiciary; it does not bind the court by law, but it is applied in practice.

The scale works with points and a rate per point. Each procedural step, such as a statement of defence or an oral hearing, earns points, and the rate per point rises with the value of the claim. Before the subdistrict court (kantonrechter), where you may act without a lawyer, a lower scale for the authorised representative (gemachtigde) applies.

Added to that are the court fee paid, the bailiff costs and a fixed amount for costs after judgment. Statutory interest runs if the costs are not paid in time. In a contested commercial case the recoverable lawyer contribution is often a fraction of the real bill, so never build a budget on recovering your costs if you win.

When can you recover your full costs?

Full recovery is the exception. In proceedings to enforce an intellectual property right, Article 1019h Rv entitles the winning party to its reasonable and proportionate actual costs, unless fairness requires otherwise.

The courts apply indicative maximum rates per type of IP case, and the claim must be specified and substantiated during the proceedings, not afterwards. A second exception is abuse of procedure: if a party brought a claim it knew was baseless, the court can award full costs as damages under the law of tort. The threshold is high.

A contract clause that the loser pays all legal costs has limited effect. Under Article 241 Rv, costs for work covered by the cost order, such as preparing court documents, can only be recovered through the cost order, not as damages. Such a clause can affect pre-trial costs; against a consumer, extrajudicial collection costs are capped by a statutory scale, as explained in our article on नेदरल्याण्ड्समा भुक्तानी नभएका बीजकहरू पुन: प्राप्ति गर्दै.

When does each party bear its own costs?

Under Article 237(1) Rv the court may set off the costs, so that each party bears its own, between spouses, registered partners and other life partners, close relatives, and where both parties lose on some points. In family cases this is common practice.

So do not count on recovering costs from a former partner, even if the outcome is entirely in your favour.

Administrative and criminal cases follow other rules. In administrative proceedings against a public authority, costs are calculated under the Decree on costs in administrative proceedings (Besluit proceskosten bestuursrecht), with points per procedural step and a fixed amount per point. A successful applicant recovers that sum plus the court fee; an unsuccessful applicant normally does not pay the authority’s costs. In criminal cases the defendant does not pay the prosecution’s costs, and a former suspect whose case ends without a penalty can apply for compensation of lawyer’s costs, which the court grants on grounds of fairness.

How does the choice of court change your cost exposure?

Under Article 93 Rv, claims up to €25,000 and all employment, rental, consumer credit and consumer sale cases go to the kantonrechter. There you may act without a lawyer and both the court fee and the recoverable contribution are lower.

Larger civil and commercial claims go to the district court (rechtbank), where a lawyer (advocaat) is compulsory and the fee and tariff rise. Our note on नेदरल्याण्ड्समा साना दावीहरू explains the lower route.

Interim relief proceedings (kort geding) are faster and have their own cost order; a party that wins in kort geding but loses the main case can face both. An appeal brings a new court fee, a new cost order and a higher tariff, and cassation at the Supreme Court (Hoge Raad) requires a specialist lawyer. A case that goes the full distance can produce three cost orders.

Under Article 224 Rv, a claimant without residence in the Netherlands must provide security for costs on the defendant’s request, unless a treaty or EU regulation exempts it. Prejudgment attachment (conservatoir beslag) brings its own bailiff costs and liability if the attachment later proves unjustified.

Who pays if you cannot afford the costs?

The Netherlands has a subsidised legal aid system run by the Legal Aid Board (Raad voor Rechtsbijstand). If your income and assets are below the statutory limits, you can receive subsidised legal aid (toevoeging): the state pays the lawyer and you pay a personal contribution based on income.

Legal aid also lowers the court fee to the lowest rate, but it does not protect you against a cost order if you lose. The limits and contributions are revised every year.

Legal expenses insurance covers much Dutch civil litigation. Once court proceedings start, you have the right to choose your own lawyer instead of the insurer’s in-house lawyer, within the policy’s terms. Check the excess, the cover limit and any waiting period before a dispute arises.

Dutch Bar rules prohibit an advocaat from making the fee depend entirely on the outcome (no cure, no pay) or taking a share of the proceeds, with limited exceptions. Commercial third-party litigation funding is possible in larger claims, in exchange for a substantial share of the proceeds.

How do you budget a dispute realistically?

A realistic budget has four lines, and only your own lawyer’s fee is truly uncertain. The court fee, the bailiff cost and the likely contribution under the liquidatietarief can all be estimated in advance.

Ask for a written estimate per phase before you instruct a lawyer, with a review point at the end of each phase. Ask what is included: only the first written round, or also the hearing, the judgment and advice on appeal. Ask what happens if the other side files a counterclaim, which often doubles the work, and which assumptions the estimate rests on.

Then compare the numbers with the claim. A claim worth less than the court fee plus your lawyer’s fee and the irrecoverable part of the costs is not worth litigating on economic grounds, however strong it is. Repeat that calculation at each stage of the proceedings.

How can you reduce the cost risk before going to court?

The cheapest case is the one that is settled. A settlement agreement (vaststellingsovereenkomst) under Article 7:900 of the Dutch Civil Code (BW) ends the dispute and removes the cost risk, as explained in our article on the vaststellingsovereenkomst का थप वस्तुहरू.

If proceedings are already pending, a settlement can be recorded in a court record or consent judgment so that it is directly enforceable. Mediation suits disputes where the relationship must continue; the parties share the mediator’s fee. Arbitration is not automatically cheaper, because the parties pay the arbitrators, but it can be faster.

Preparation is the most effective cost control. A file that is complete at the start needs fewer procedural rounds, which means both a lower bill and a lower cost order if you lose. Our मुद्दा दायर टोली assesses the position and the cost exposure before proceedings start.

दावीकर्ताको रूपमा तपाईंले के जाँच गर्नुपर्छ?

As a claimant you take the first cost decisions. Check these points before you issue a writ of summons or petition.

  • Which court is competent: the kantonrechter (claims up to €25,000 and employment, rental and consumer cases) or the district court?
  • What is the current court fee for your claim value and type of litigant on rechtspraak.nl?
  • What contribution can you realistically recover under the liquidatietarief if you win?
  • Can the defendant actually pay a judgment and a cost order, or is prejudgment attachment needed?
  • Does your legal expenses insurance cover the case, and what are the excess and cover limit?

प्रतिवादीको रूपमा तपाईंले के जाँच गर्नुपर्छ?

As a defendant your cost exposure depends on the claim and your response. Check these points as soon as you receive the summons.

  • What is the deadline in the writ of summons for entering an appearance, and has a court fee become due?
  • Is the claimant domiciled outside the Netherlands, so that you can ask for security for costs under Article 224 Rv?
  • Does a counterclaim make sense, and what does it add to the cost and the court fee?
  • Is an early settlement offer cheaper than defending the case through a hearing?
  • Does a contractual cost clause apply, and how far does Article 241 Rv limit it?

बारम्बार सोधिने प्रश्नहरू

How are legal costs calculated in Dutch courts?

Two different sums are involved. The court fee (griffierecht) is set by the Court Fees in Civil Cases Act according to the claim value and type of litigant and changes every year. The contribution the losing party pays towards the winner’s lawyer is calculated under the liquidatietarief: points per procedural step multiplied by a rate that depends on the claim value.

What happens to the costs if I lose my case?

Under Article 237 Rv you are ordered to pay the costs of the proceedings: the other side’s court fee, bailiff costs and a fixed contribution to its lawyer’s fees. You also pay your own lawyer. Full recovery of actual costs applies mainly in intellectual property cases under Article 1019h Rv.

Can I reduce my legal costs in a Dutch dispute?

Yes. Settle where possible, for example in a settlement agreement under Article 7:900 BW, prepare the file completely before proceedings start, ask for a written estimate per phase, and check whether your claim belongs before the kantonrechter, where fees and tariffs are lower.
